Terms of Service

These Terms of Service ("Terms") govern your access to and use of the SetterFlo platform, website at setterflo.io, and related services (collectively, the "Service") operated by NoCoded Ltd ("SetterFlo", "we", "us", or "our"). By accessing or using the Service, you agree to be bound by these Terms.

1. Eligibility

You must be at least 18 years old and have the legal capacity to enter into a binding agreement to use our Service. By using SetterFlo, you represent that you meet these requirements.

2. Account Registration

  • You must provide accurate and complete information when creating an account.
  • You are responsible for maintaining the security of your account credentials.
  • You are responsible for all activity that occurs under your account.
  • You must notify us immediately of any unauthorised use of your account.

3. Description of Service

SetterFlo provides an AI-powered Instagram Direct Message management platform that helps users respond to DMs, qualify leads, and book appointments. The Service includes:

  • AI-assisted responses to Instagram Direct Messages on your behalf.
  • Lead qualification and AI-assisted booking.
  • Analytics and performance tracking.
  • Calendar integrations for scheduling.
  • Custom AI voice and tone training.

4. Instagram & Meta Compliance

  • You must comply with Meta's (Instagram's) Terms of Service and Community Guidelines at all times.
  • You grant SetterFlo permission to access and interact with your Instagram account as necessary to provide the Service.
  • You are solely responsible for the content sent through your Instagram account via our Service, even when generated by AI.
  • You must not use SetterFlo to send spam, unsolicited messages, or content that violates Meta's policies.
  • We are not affiliated with, endorsed by, or sponsored by Meta Platforms, Inc.

Permission Usage

SetterFlo requests the following Meta API permissions to deliver the Service:

  • instagram_basic: Used to retrieve your Instagram profile information (name, username, profile picture) for display in the dashboard.
  • instagram_manage_messages: Used to read incoming Direct Messages and send AI-assisted responses on your behalf, as configured in your AI Settings.
  • instagram_manage_comments: Used to read and respond to comments on your posts and reels, enabling engagement with your audience directly from the dashboard.
  • pages_messaging: A technical requirement for the Instagram Messaging API. No Facebook Page messages are read or sent.

You may revoke any of these permissions at any time by disconnecting your Instagram account in your SetterFlo dashboard or through your Instagram/Facebook settings. See our Privacy Policy for full details on how data from each permission is used and stored.

5. Acceptable Use

You agree not to use the Service to:

  • Send spam, unsolicited messages, or bulk messages.
  • Harass, threaten, or abuse others.
  • Distribute illegal, harmful, or objectionable content.
  • Impersonate another person or entity.
  • Violate any applicable law, regulation, or third-party rights.
  • Attempt to gain unauthorised access to our systems or other users' accounts.
  • Reverse-engineer, decompile, or disassemble any part of the Service.
  • Use the Service in any way that could damage, disable, or impair our infrastructure.

6. AI-Generated Content

  • SetterFlo uses artificial intelligence to generate message responses. While we strive for accuracy and quality, AI-generated content may occasionally be inaccurate or inappropriate.
  • You are ultimately responsible for reviewing and approving the AI's behaviour and the messages sent on your behalf.
  • We recommend using Co-Pilot mode when first setting up to review AI responses before they are sent.
  • SetterFlo is not liable for any consequences arising from AI-generated messages sent through your account.

7. Subscription & Payments

  • SetterFlo is offered on a subscription basis. Pricing is as displayed on our website at the time of purchase.
  • Subscriptions renew automatically unless cancelled before the renewal date.
  • All fees are quoted in GBP and are exclusive of applicable taxes unless stated otherwise.
  • We may change our pricing with 30 days' notice. Continued use after a price change constitutes acceptance.
  • Payments are processed securely through Stripe.

8. Free Trial

We may offer a free trial period. At the end of the trial, your subscription will automatically convert to a paid plan unless you cancel before the trial ends. We will notify you before your trial expires.

9. Cancellation & Refunds

  • You may cancel your subscription at any time from your account settings.
  • Cancellation takes effect at the end of your current billing period.
  • We do not provide refunds for partial billing periods.
  • Upon cancellation, your AI setter will stop responding to new messages, but you will retain access to your dashboard and data until the end of the billing period.

10. Data Deletion Rights

You have the right to request deletion of your personal data at any time. You can do so by:

  • Emailing support@setterflo.io with the subject "Data Deletion Request".
  • Disconnecting your Instagram account in your dashboard Settings.
  • Visiting our Data Deletion page for full details.

We will process deletion requests within 30 days. See our Privacy Policy for details on what data is deleted and what is retained for legal compliance.

11. Intellectual Property

  • The Service, including its design, features, and underlying technology, is owned by NoCoded Ltd and protected by intellectual property laws.
  • You retain ownership of your content, including your custom training data and conversation scripts.
  • You grant us a limited licence to use your content solely to provide and improve the Service.

12. Data Protection

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal data.

13. Limitation of Liability

To the maximum extent permitted by law:

  • SetterFlo is provided "as is" and "as available" without warranties of any kind.
  • We do not guarantee that the Service will be uninterrupted, error-free, or that AI responses will always be accurate.
  • Our total liability for any claims arising from your use of the Service shall not exceed the amount you paid us in the 12 months preceding the claim.
  • We are not liable for indirect, incidental, consequential, or punitive damages, including lost revenue, lost profits, or loss of business opportunities.

14. Indemnification

You agree to indemnify and hold harmless NoCoded Ltd and its officers, directors, employees, and agents from any claims, losses, or damages (including legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

15. Termination

  • We may suspend or terminate your access to the Service at any time if you violate these Terms or engage in conduct that we determine is harmful to other users or our business.
  • Upon termination, your right to use the Service ceases immediately.
  • We will make your data available for export for 30 days following termination.

16. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by email or by posting a notice on our website. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

17. Governing Law

These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
